I Don't Do Court: Being Prepared for Court Involved When You Can't Opt Out

The adversarial nature of a court proceeding seems antithetical to the counseling process - and many counselors seek to avoid court-involved roles. However, the decision to refrain from knowingly taking on roles that require court involvement does not insulate a counselor from being subpoenaed to testify in a legal matter connected to one of their clients. This workshop will focus on increasing counselor preparedness for court involvement when the counselor can't opt out. The presenter, an attorney and counselor educator, will familiarize attendees with terminology associated with legal proceedings and with what to do in response to receipt of a subpoena. Attendees will also learn more about intentional roles a counselor can fill, such as expert witness, evaluator, and parenting coordinator - and how those roles can align with the holistic nature of counselor identity. 

Learning Objectives:

  • Identify and define common legal terminology associated with court proceedings in which counselors may become involved.
  • Discuss how to respond to a subpoena and increase preparedness for testimony in various court matters and proceedings.
  • Explore specific intentional roles counselors can fill which include court involvement, such as expert, evaluator, and parenting coordinator.

Ann M. Ordway, JD, PhD, is a core faculty member with the on-campus Counselor Education Department at the University of Phoenix. She was a practicing attorney for 25 years, with a practice focus on high conflict family litigation, including intimate partner violence, custody matters, and child protective services proceedings. Dr. Ordway is a family mediator, child advocate, and parenting coordinator. She is an active member of the American Counseling Association and has presented Learning Institutes at the annual conferences four years in a row. Ann is a Trustee for the Association of Creativity in Counseling, and the Chair of the Emerging Leaders Committee for the International Association of Marriage and Family Counselors. She and her family relocated to Gilbert, Arizona in May 2018 and she is excited to be a part of the Arizona Counseling Association.
